TITLE 34
BOATING AND WATER ORDINANCE
(Adopted April 4, 2006 by Ordinance 2006-5)
RECITALS
WHEREAS, the Weber County Sheriff’s Office is charged with the enforcement and
regulation of the boating, water craft and other uses of the various rivers, lakes and reservoirs within
Weber County; and
WHEREAS, in the course of the Sheriff’s enforcement duties it is often necessary to cite
individuals for violations of the various state rules regulating conduct on the county’s waterways; and
WHEREAS, Weber County would like to cite violators for county ordinance violations
rather than state code violations since violators are processed by county enforcement officers,
prosecuted in county courts by county prosecutors, and incarcerated, if necessary, in county jails;
NOW THEREFORE, be it ordained by the Weber County Commission as follows:

34-1-3 Citation
34-1-1 Adoption of the Utah Code Boating and Water, Rules and Regulations.
The Rules and Regulations contained in Utah Code Annotated Title 73, Chapters 18, 18a, 18b
and18c, (1953), as amended, and the rules promulgated thereunder, are hereby adopted as the
Boating and Water Rules and Regulations of Weber County, and by this reference are made a part
of Title 34, Weber County Revised Ordinances to the same extent and effect as though said Title,
Chapters, Sections and Rules were set forth herein in full. Any provisions of Title73 providing a
penalty greater than a Class B misdemeanor, or not relating to criminal or administrative sanctions,
are not incorporated as part of this ordinance.
34-1-2 Amendments.
In order to assure continuing uniformity between the Utah State Boating and Water Rules and
Regulations and the Weber County Boating and Water Rules and Regulations, as required by UCA
73-18-17, this Ordinance will include any and all periodic amendments to the State Rules and
Regulations, Title 73, Chapter 18,18a, 18b and 18c, after the effective date of this title, made by the
Utah State Legislature or by the Utah Department of Natural Resources. 34-1-3 Citation.
These ordinances shall be designated as a Weber County Ordinance by substituting Title 34
for Title 73, followed by the appropriate Chapter and Section numbers of the Utah Code.
33.1.4 Effective Date.
This Ordinance shall take effect 15 days after passage, after required publication and after a
copy of the ordinance is deposited with the Weber County Clerk’s Office.
